TERMS AND CONDITIONS for “Hits Radio North East & Hits Radio Teesside – The 1K Minute” (the “Competition”).

These terms and conditions (the “Specific Terms”) for the Competition should be read alongside our general competition terms and conditions at: https://www.bauerlegal.co.uk/competition-general-terms-and-conditions-20230711  (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail.

The 1K Minute Terms and Conditions

Players can enter the 1K Minute on Steve and Karen’s Breakfast Show;

(A) By calling 0191 488 3188 when invited by the presenters.

(B) By filling in the online entry form.

We reserve the right to locate a competitor via another method - if there is a technical issue.

One player will be chosen at random from the database, and if the competitor cannot play for any reason - this will be stated on air and another player will be selected from the database.

Phone entries received outside of the shows hours will not be counted but may still be charged. Calls will be charged at your standard network rate. Always ask the bill payer’s permission

COMPETITION MECHANIC AND HOW TO WIN

All valid entries from both phone and online will be pooled together, and a player will be chosen by electronic random draw every day. If an entrant cannot be sourced or cannot play, we reserve the right to redraw until an entrant can be located. Any entrants that cannot be contacted or cannot play that day will be placed back into the pool for future rounds. The Competitor will be asked a series of up to ten (10) questions in sixty (60) seconds (“Time Limit”) on air. Only the first answer given to each question will be accepted. Competitors can pass on questions by stating “Pass”, and if there is time after the ten (10) questions are asked, the presenter will return to those passed questions. Then, and only then, will an answer be accepted for those questions. An independent adjudicator will be present at the station to resolve any disputes. The adjudicator’s decision shall be final and no further discussion will be entered into. If the Competitor answers all ten (10) questions correctly within the Time Limit, they will win £1000!

ENTRY PERIOD

Entries must be submitted during the following entry period:

Phone Entries are open whenever Steve and Karen’s Breakfast Show is airing. Entrants can enter the competition by calling 0191 488 3188. Online Entries can be entered at any time, however, will not be considered till the following day. Online entries are free.

We also reserve the right not to run or pause the competition during any major weather, news or station events. Our production team reserve the right to cancel the competition during such an event, our decision in this case would be final and no correspondence will be entered.

The 1K Minute will be played on air every weekday at approximately 08:10 - Excluding weekends and public holidays or unless otherwise stated on air. Entries received outside of entry periods will be invalid. Winner Announcement. The name and the home town of the winner will be announced on Metro Radio and TFM at approximately 08:10

ENTRY RESTRICTIONS

• Open to UK residents aged 18 years or over on date of entry.

• Entries are restricted to one entry per person.

• Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter.

• We reserve the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to draw a winner that fulfils all of the eligibility criteria and is in compliance with these Terms.

Other entry restrictions are as follows:

The Competition is only open to residents of The North East and North Yorkshire, with entrants living in postcodes beginning with NE, SR, DH, DL and TS, with certain exceptions made for those in HG and YO Postcodes. Entrants must be aged 18 years or over at the date of their entry.

Entrants must not have played the competition on-air in the previous 3 months, regardless of losing on their previous attempt. Previous winners must not play the competition on-air again within 12 months of winning.

THE PRIZE

One winner will receive the following prize (the “Prize”): If the Competitor answers all ten (10) questions correctly within the Time Limit, they will win £1000!

The Prize is provided by The MetroCentre (the “Prize Provider”). Bauer Media are not responsible for any aspect of the Prize, including unsatisfactory quality or late delivery or a prize winner being unable to take up any aspect, or the entirety of the prize due to their own circumstances or restrictions.

Prizes are non-transferable, non-refundable and no cash alternative will be offered. The prize is payable by a bank transfer and will be delivered to the winners nominated account within 28 days of them sending their details.

If this can’t take, place a cheque will be raised within 28 days of the winner providing a valid photo ID and separate proof of address.

Metro Radio and TFM, The Promoter, reserves the right to make the prize payment by an alternative means should payment by cheque not be possible for any reason.

OTHER CONDITIONS

1. DATA PROTECTION.

Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider) will be collected and used to process entries. Winner’s details may be given to a Prize Provider to arrange delivery of the prize. Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry. For SMS entries you automatically consent to receive marketing. You may opt out at any time by texting the word STOP to the relevant text shortcode number. If you have opted in to receive marketing communications, then your details will be used in accordance with the information given when you ticked the opt-in box and gave your consent. 2. INTELLECTUAL PROPERTY AND CONSENTS.

By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.

3. MISCELLANEOUS.

• Entries which do not comply with these Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Terms.

• Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into.

• We are not responsible if you fail to get through when you call or if you lose signal during a call.

• You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via phone call entry route.

• We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition.

• Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and reawarded to another entrant.

• As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize. We may cancel, end or suspend the Competition where we are required to do so in circumstances outside our control. We reserve the right to amend these Terms at any stage during the Competition if such amendment is necessary to facilitate the administration of the Competition.
