T&Cs Lidl Holiday Giveaway - HITS RADIO

TERMS AND CONDITIONS for “Hits x Lidl Food Themes” (the “Competition”).

These terms and conditions (the “Specific Terms”) for the Competition should be read alongside our general competition terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail.

1.ENTRY ROUTES AND COSTS

ON-AIR COMPETITION:

The on-air prize is shared prize across 6 Hits Radio England stations:

• Hits Radio Bournemouth & Poole

• Hits Radio Bristol & South West

• Hits Radio Cumbria

• Hits Radio Manchester

• Hits Radio National

• Hits Radio South Coast

Entries are restricted to one entry per person.

Entry to the Competition is available via the following routes:

Calls cost 7p per minute plus your phone company’s access charge

2.COMPETITION MECHANIC AND HOW TO WIN

ON-AIR COMPETITION:

• There will be 4 opportunities to win from Tuesday 9th May – Friday 12th May in the Hits Radio Breakfast Show between 6:00am and 10:00am.

• To be eligible to win, entrants must call when promoted by the on-air presenter to be in with the chance of being selected to be brought to air to play to win.

• An entrant will be selected at random from all calls and will be asked to play the competition.

Mechanic:

• Breakfast Show presenter James will take part in a blindfolded taste test where he will describe the food he’s eating. Each piece of food eaten and described daily will be from a different location. The caller is playing to win a holiday to said location (detailed in section 5). Once James has explained the food, entrants will be promoted to call by the on-air presenter to be in with a chance of being selected to be bought to air to play to win.

• One caller who will be randomly selected from all those who entered will be bought to air to play to win

• Once on-air the caller will need to correctly guess the country James from the Hits Breakfast show described through his eating challenge.

• For each cuisine guessed correctly, a holiday will be given away.

• If a question is answered incorrectly the caller will not win the prize associated and this prize will be lost. The on-air presenter will then go to the next caller.

If the caller doesn’t answer any questions correctly, they will not be deemed a winner and therefore they will not win the prize and another winner will not be contacted.

  1. ENTRY PERIOD

ON-AIR COMPETITION:

• Entries must be submitted during the following entry period:

• Daily from Tuesday 9th May to Friday 12th May between 6am (the “Start Time”) and 10am (“End Time”)*.

• *The specific opening and closing times of the on-air competition will be announced by the presenter during each show (6am-10am).

• Entries received before the Start Time or after the End Time will be invalid.

• If an entrant is successfully deemed a winner, the team will be in touch with them within 28 working days to arrange delivery of the prize. However if the winner cannot be contacted within 28 days from the date of the initial attempt to contact them/the on-air draw, then we will re-draw until we draw a winner that we are satisfied (in our sole discretion) fulfils all of the eligibility criteria and is in compliance with these Terms.

  1. ENTRY RESTRICTIONS ON-AIR COMPETITION:

• Open to UK residents aged 18 years or over on date of entry.

• Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter.

• We reserve the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to draw a winner that fulfils all of the eligibility criteria and is in compliance with these Terms.

Prizes are non-negotiable, non-transferable, non-refundable and no alternative will be offered to the prize.

ELEMENT T&CS’s:

Economy class flights available from London only; Flights include hand luggage only, may be indirect and not all routings will be available; Flight itinerary will be selected by the prize provider at their sole discretion; Winner and guests must travel at the same time with the same itinerary; At least one traveller must be aged 18 or over; Children under 18 will require parent or guardian permission prior to travel; Stay must include a Saturday night; A valid credit or debit card will be required for security deposit purposes when checking into the hotel; Accommodation is based on 2 x adults sharing a double/twin room; Hotel accommodation will be selected by the prize provider at their sole discretion; All prize elements are subject to availability; If unavailable, experiences of a similar nature and value may be offered at prize provider’s discretion; Winners must contact prize provider with three preferred travel dates in three separate months no later than six weeks prior to departure; All elements of the prize must be taken at the same time; Prize is non-refundable and non-transferable; No cash alternative is available; Prize is valid for 12 months from the date of notification of winning, and all travel must be completed within that time; The prize cannot be taken from 22nd December to 02nd January (Christmas and New Year), over public holidays in the UK and or destination country, over Easter Sunday or during the months of July and August; Once booked, the prize cannot be amended or cancelled; The prize excludes travel from the winner’s home address to departure airport, meals and drinks (except where specified above), excursions, attractions, treatments, car hire, visas and personal expenses and anything not expressly included in the prize; All travellers will require a passport valid for at least 6 months on date of travel; Travel insurance is subject to restrictions and the terms and conditions of the insurance provider. It is the responsibility of the winner and/or their companion(s) to meet any additional costs relating to obtaining insurance cover for any pre-existing medical condition and for any additional costs as may be specified where the winner and/or their companion(s) are aged 70 or over; Any necessary visas or additional insurance are the responsibility of the winner and their guests; If the winner elects not to, or is unable to, use part of the prize, the winner will forfeit that part of the prize package; Prize must be taken in accordance with government guidelines and COVID-19 rules and restrictions in place at the time of travel. The arrangement and additional costs for any COVID-19 testing or other expenses that may be incurred are the sole responsibility of the winner and guest; The Prize Provider is Element London Ltd. OTHER CONDITIONS

  1. DATA PROTECTION. Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider) will be collected and used to process entries. Winner’s details may be given to a Prize Provider to arrange delivery of the prize. Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry. For SMS entries you automatically consent to receive marketing. You may opt out at any time by texting the word STOP to the relevant text shortcode number. If you have opted in to receive marketing communications, then your details will be used in accordance with the information given when you ticked the opt-in box and gave your consent.   1. INTELLECTUAL PROPERTY AND CONSENTS. By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.
  1. MISCELLANEOUS.

• Entries which do not comply with these Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Terms.

• Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into.

• We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call.

• You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route.

• We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition.

• Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant.

• As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize.

We may cancel, end or suspend the Competition where we are required to do so in circumstances outside our control. We reserve the right to amend these Terms at any stage during the Competition if such amendment is necessary to facilitate the administration of the Competition.
