It has been almost 5 months since new laws came into force banning drivers from smoking in cars with under 18's on board.

However, we can exclusively reveal only one person has been caught falling foul of the rules since then.

A freedom of information request to Police Scotland showed the force has only used the powers once since December 5th.

The single incident happened in Fife but Health Minister Aileen Campbell says its not fair to judge success on the number of punishments dished out.

She spoke to our reporter Paul Kelly:

The law came about via a members' bill by then Lib Dem MSP Jim Hume - and received unanimous back in parliament.

It also got the support of anti-smoking group ASH Scotland and their chief executive, Sheila Duffy, still stands behind it. She spoke to Kayleigh Harvey:

Anyone caught lighting up with under 18's in the passenger seat could be handed a fine of up to £1,000.
