In consideration of Cool FM Cash for Kids providing you with the opportunity to take part in the Event, you agree to be bound by these Terms and Conditions (the “Terms”) and you should read them carefully before registering for and taking part in the Event.

The Boo Ball (the “Event”) is a fundraising event organised and managed by Bauer Radio’s Cool FM and Cash for Kids Charities (registered charity number: 1122062, registered company number 06424810) whose registered office address is C/o Cash For Kids, Hampdon House Falcon Court, Preston Farm Industrial Estate, Stockton-On-Tees, England, TS18 3TS (the “Event Organiser”, “Cash for Kids”, “we”, “us”, “our”).

The Event is a family event with options for all fitness levels. By submitting the entry form (the “Entry Form”) and paying the registration fee, you are indicating your acceptance to be bound by these Terms including the “We are Vertigo” terms and conditions applicable to your access and use of the venue (and its facilities) hosting the Event which are set out at the bottom of these Terms. If you do not accept these Terms, you should not submit the entry form and/ or pay the registration fee but this means that you will be unable to take part in the Event.

1.1. You confirm that: 1.1.1. You are legally capable of entering into a binding contractual agreement with us on the Terms; 1.1.2. You are at least 18 years of age or older to purchase a ticket; and 1.1.3. You understand and agree to comply with these Terms. 1.2. Once tickets become available and you have entered your personal details onto the Entry Form, you should check that they are correct before you proceed to pay the £2.50 fee (the “Registration Fee”). 1.3. Participants must register to take part in the Event. Accompanying adults who are not intending to participate but who are intending to supervise from the viewing gallery only do not require tickets and should register and pay for participating children only.

2.1. We accept payment made by credit or debit cards and, sometimes, via third party payment providers such as PayPal. 2.2. When you click “Pay” this represents an offer to us from you to take part in the Event. We will then process your payment for the Registration Fee. 2.3. Once payment has been taken, we will then send you an email confirming your place in the Event. At this point you will have concluded a legally binding contract with us on these Terms. 2.4. Please note that the Registration Fee does NOT include any additional or indirect fees, expenses or costs associated with taking part in the Event, such as transport to and from the Event, venue, medical costs, food and drink, optional add-ons (e.g. photos). 2.5. Places in the Event are limited, and will be allocated on a first-come, first-served basis.

3.1. Accurate information: You must provide truthful and accurate information when registering for the Event. It is your responsibility to make sure you do so. We reserve the right to cancel your Event registration immediately if: 3.1.1. when requested by us to do so, you fail to provide us within a reasonable time with sufficient information to enable us to determine the accuracy and validity of the information given in your Entry Form; 3.1.2. we feel that you are using information or payment details that do not belong to you; and we reserve the right to pass on this information to the regulatory authorities.

4.1. Participants are responsible for ensuring that they wear clothing and footwear appropriate to the Event (Grippy socks are compulsory can be purchased at an additional price from reception at the We are Vertigo venue). 4.2. Participants are responsible for their own possessions during the Event. 4.3. Participants are advised not to take any non-essential personal possessions with them into the event

5.1. Only registered participants are authorised in the Event 5.1.1 Participants under 16 must be accompanied by an adult 5.2. Participation in the Event may expose you to the risk of personal injury and it is each participant’s responsibility to ensure that they are fit enough to take part. To minimise the risk of causing harm to yourself, we ask all participants to – 5.2.1. follow all health and safety instructions given on the day; 5.2.2. take care to ensure that, to the best of their knowledge, they are fit to participate in the Event; 5.2.3. refrain from taking part if they are suffering from any disease or medical condition which may prevent them from safely taking part or which may be aggravated if they do; 5.2.4. refrain from taking part if they feel unwell/are in pain during the Event; 5.2.5. seek suitable medical advice prior to and refrain from taking part if they are advised not to. 5.3. We reserve the right to refuse your participation in the Event if you appear unfit to participate. 5.4. We encourage you to be sensible and take all safety precautions highlighted to you by your doctors, by any representatives of the Event Organiser or any 3rd party Event organiser. 5.5. Please tell a representative of the Event Organiser or on-site first aid personnel if you feel unwell at any time directly before, during or after the Event. 5.6. Nominated First Aid personnel authorised by the Event Organiser to do so may examine any participant who appears to be in distress. The sole opinion of authorised First Aid personnel is in the best interest of the participant's health and welfare. First Aid personnel may remove the participant from the Event. 5.7. Participants are responsible for any and all medical expenses incurred as a result of training for and/or participation in the event, including but not limited to ambulance transport, hospital stays, physician and pharmaceutical goods and services. 5.8. Under no circumstances shall illegal substances or alcohol may be carried or consumed by participants taking part in the Event. You will be disqualified immediately if you are found to be carrying drugs or alcohol and/or are visibly intoxicated on your arrival and you will be asked to leave the venue immediately. 5.9. Participants are expected to conduct themselves in a positive and courteous manner during their participation in the Event. This means, that any anti-social behaviour on or near the Event venue will be reported immediately to the authorities. Participants violating this rule of conduct shall be disqualified from the Event and will be asked to leave the Event venue. 5.10. Participants with a disability or who require special arrangements to be made in order for them to take part in the Event should contact the Event Organiser prior to registering in the Event on 028 9181 5555.

6.1. The Event Organiser would love to share your experiences and achievement at the Event. You agree that the Event Organiser may take photographs of and /or film you at and during the Event and that we will be the owner of these photographs or film recordings. You agree that we may use your first name, likeness and/or voice when we publish these photographs or film. You agree that you will not make a claim against the Event Organiser in respect of any uses made of the photographs or recordings taken of you during the Event and you agree to waive any moral rights which you may have and which may exist in them. 6.2. When completing an Entry Form, you are submitting your personal data to the Event Organiser. This will be used to process your entry to the Event. If necessary to do so, we may also pass this personal information to Bauer Radio Limited and to other companies’ in Bauer Radio Limited’s group. This is because these companies provide us with certain support functions needed to operate our business. We may also provide the information provided in your Entry Form, as well as any additional information provided in relation to the Event, to any third parties we may engage from time to time to arrange the Event. We will only do this to process your entry to the Event. The data submitted in your Entry Form will be deleted shortly after the Event. 6.3. We also reserve the right to provide your details to any regulatory, governmental or law enforcement agencies who may request them or to investigate misuse of the site or any breach or potential breach of these Terms. 6.4. Notwithstanding the above, if you have consented to do so on your Entry Form, we may store your email address to send you emails about our work and future fundraising events and how your fundraising enables us to help children in your local area who are disabled, disadvantaged or suffering from abuse or neglect. You can unsubscribe at any time by following the instructions given in our privacy policy or in the emails that we send to you. 6.5. Payment details will be kept for 6 years for taxation reasons and will then be destroyed.

7.1. In most circumstances, you have a legal right to cancel your contract with is within fourteen (14) days of our email confirmation sent pursuant to clause 1 above. 7.2. To cancel your registration, please send an e-mail to ni@cashforkids.org.uk and state that you request to cancel your registration. Please provide your full name and attach the registration confirmation sent to you by the Event Organisers. You should keep a copy of your cancellation email for your own records. Your cancellation is effective from the date you send us the cancellation e-mail. 7.3. Please note that your right to cancel is lost if you register less than 14 days before the Event is due to take place. 7.4. Following notification of cancellation, the Registration Fee shall be credited to you within the fourteen (14) day cancellation period. 7.5. More advice about your legal right to cancel is available from your local Trading Standards office. 7.6. We reserve the right to terminate our agreement with you (governed by these Terms) and /or refuse your participation in the Event, if we suspect that you have breached these Terms or if it becomes clear that you have engaged, or are about to engage, or have in any way been involved in fraudulent or illegal activity concerning the Event or this website. 7.7. If we terminate your contract under section 7.6, above, we will not refund your Registration Fee. 7.8. The Event Organiser reserves the right to change the course, or make any other amendment to the Event that they deem necessary. Any change to the Event will be communicated to participants at the Event or sooner if practicable. 7.9. The Event Organiser reserves the right to modify, supplement or waive all or part of these Terms without notice. It is the participant’s responsibility to check the Event website for any changes. 7.10. Participants shall be bound by any modification or supplement of the Event Terms published prior to the Event. 7.11. In the interest of safety, the Event Organiser and event officials, in consultation with the Police and Emergency Services, reserve the right to delay, cancel, or suspend the Event due to extreme inclement weather or a major incident on or near the Event course. 7.12. Should the Event be cancelled, delayed or postponed for any reason, participants will not be entitled to a refund of the Registration Fee and the Event Organiser will not be liable for any inconvenience, expenses, costs, losses or damages suffered by participants.

8.1. Participants take part in the Event at their own risk and will not hold the Event Organisers or any connected persons responsible, to the fullest extent possible in law, for any accident, injury or illness sustained. 8.2. You may not transfer, assign, charge or otherwise dispose of any of your rights or obligations arising under these Terms. 8.3. A person who is not a party to these Terms shall have no right under the Contracts (Rights of Third Parties) Act 1999 or otherwise to enforce any term of them against the Event Organiser. However, the Event Organiser is permitted to enforce these terms against all Event participants, including anyone entered as part of a group or family entry. 8.4. If any of these Terms or any part thereof are unenforceable, the enforceability of all other terms and conditions shall not be affected. 8.5. No failure by us to exercise any right or remedy under these Terms shall operate as a waiver of that right or remedy and no waiver by us of any breach of these Terms shall operate as a waiver of any subsequent breach. 8.6. These Terms shall be governed and construed according to English law and the English courts shall have exclusive jurisdiction regarding any claim or matter arising under these Terms. 8.7. You will indemnify and keep us indemnified against any damage, loss, liability or cost incurred by us resulting from any breach of these Terms by you.

Terms and Conditions for We Are Vertigo (The Venue)

On Site & Our Services:

  1. We are Vertigo operates a strict ‘NO PICNIC’ policy. Only food and drink purchased on the premises may be

consumed on site & Birthday Cakes are permitted for booked party rooms ONLY and not for parties using our

General Admission facilities. There is a strict NO alcohol policy when using any of our equipment here at We are Vertigo.

  1. Children under 16 years of age must be supervised by an accompanying adult at all times in the We are Vertigo centre.
  1. We would ask customers to report any accidents to reception before leaving the centre. Accidents reported

after leaving our site cannot be dealt with appropriately.

  1. The Management reserve the right to refuse admission.
  1. YNO foul language or abuse of our staff will be tolerated at any time.
  1. NO adult football tops or baseball caps are to be worn in centre at any time.
  1. In our Inflatable Park, We Are Vertigo Slippy Grippy Socks must be used at all times (when available). Adults are not permitted in and around the Inflatable Area unless they have paid full admission and are wearing the appropriate footwear. A viewing gallery has been provided to allow for the monitoring of children if you feel it is required.
  1. The Inflatable Park and the associated activities within, not limited to bouncing, are physical activities which all participants (or parent/guardian/ supervising adult for participants under the age of 18) must ensure that they are fit and able to participate in unaided.
